User Consent & Data Agreement

This User Consent & Data Agreement (“Agreement”) is executed between:

This User Consent & Data Agreement (“Consent Agreement”) is executed between MKS Partners LLP, having its corporate office at T-01 Rayaba Building, Vidhate Park, Aundh, Pune 411007, being the owner and operator of the digital investment platform SiP24Seven (hereinafter referred to as “the Platform”)

AND

The individual registering on the SiP24Seven website, mobile application, or any associated digital platform (hereinafter referred to as “the User” / “the Investor”)

The Platform and the User are hereinafter collectively referred to as the “Parties”.

USER DECLARATION AND ELIGIBILITY

The User hereby declares and confirms that:

  • The User hereby declares that they are above 18 years of age and are legally competent to enter into a binding agreement under applicable laws in India.
  • The User confirms that all personal, financial, and other information provided on the Platform is true, complete, and accurate to the best of their knowledge.
  • The User undertakes to promptly update any changes in their personal details, contact information, or financial information as may be required for continued use of the services.
  • The User acknowledges that providing incorrect or incomplete information may result in denial, suspension, or termination of services by the Platform.

CONSENT FOR COLLECTION AND VERIFICATION OF INFORMATION

The User hereby consents to the collection and processing of the following categories of data:

  • The User hereby provides consent to the Platform to collect, store, and verify personal and financial information for the purpose of providing services through the Platform.
  • Such information may include identity details, contact details, financial information, and other relevant data required for onboarding and service delivery.
  • The User further consents to the Platform verifying such information through appropriate channels, including regulatory or authorised agencies, in accordance with applicable laws and guidelines issued by SEBI, AMFI, and other authorities.

CONSENT FOR USAGE AND SHARING OF INFORMATION

The User gives explicit consent to the Platform sharing their data with the following categories of recipients, strictly on a need-to-know basis:

  • The User agrees that the Platform may use the information provided by the User for the purpose of:
    • providing access to the Platform and related services;
    • processing transactions and maintaining records;
    • improving the quality of services and user experience.
  • The User further agrees that such information may be shared, on a need-to-know basis, with:
    • Asset Management Companies (AMCs) and other financial institutions for processing transactions;
    • regulatory authorities or government bodies as required under applicable laws;
    • third-party service providers engaged by the Platform for operational and support purposes.
  • The Platform shall take reasonable steps to ensure that such information is handled in a secure and confidential manner.

INVESTMENT UNDERSTANDING AND ACKNOWLEDGEMENT

The User hereby acknowledges and agrees that:

  • The User acknowledges that the Platform is engaged in the business of Mutual Fund Distribution and does not provide investment advisory services.
  • The User understands that all information made available on the Platform is general in nature and is not intended to constitute investment advice, recommendation, or solicitation.
  • The User agrees that all investment decisions are taken at their own discretion and risk.
  • The User further acknowledges that investments in mutual funds and other financial products are subject to market risks and that they have understood the associated risks before making any investment.

ELECTRONIC RECORD AND CONSENT

The User hereby acknowledges and agrees that:

  • This Agreement constitutes an electronic record under the provisions of the Information Technology Act, 2000 and does not require any physical or digital signature.
  • The User’s access to and use of the Platform shall be deemed to constitute valid acceptance of this Agreement.
  • The User agrees that all transactions, instructions, and communications carried out through the Platform shall be treated as legally valid and binding.

COMMUNICATION CONSENT

The User hereby consents to receiving communications from the Platform:

  • The User agrees to receive communications from the Platform in connection with the use of the Platform and services provided, including transaction updates, service notifications, and other relevant information.
  • Such communications may be made through electronic modes including email, SMS, or application-based notifications.

ACCEPTANCE OF TERMS

The User hereby confirms that:

  • By accessing or using the Platform, the User confirms that they have read, understood, and agreed to the terms of this Agreement.
  • If the User does not agree with the terms of this Agreement, they are advised not to use the Platform or avail any services provided by the Platform.
